Copyright Policy
Pagio respects intellectual property rights and expects our users to do the same. This Copyright Policy explains our approach to copyright protection and our procedures for addressing infringement claims.
Respect for Intellectual Property
Pagio is committed to protecting the intellectual property rights of creators, artists, and rights holders. We comply with applicable copyright laws, including South Africa's Copyright Act No. 98 of 1978 and the Electronic Communications and Transactions Act No. 25 of 2002.
Your Responsibilities
- Only upload content that you have created yourself or for which you have obtained all necessary rights, licenses, and permissions
- Respect copyright and other intellectual property laws
- Do not share copyrighted material without proper authorization from the rights holder
- Understand that "fair dealing" exceptions in South African law are limited and specific - do not rely on them without proper legal advice
- Remember that giving credit to the original creator does not substitute for obtaining permission
Prohibited Content: You may not upload, post, or share content that infringes on any intellectual property rights, including copyrighted movies, TV shows, music, books, software, images, or other protected works without proper authorization.
Reporting Copyright Infringement
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible through our Service, please send a written infringement notice to pagio.app@gmail.com that includes the following information:
- Your contact information (name, address, telephone number, and email address)
- A detailed description of the copyrighted work that you claim has been infringed
- The specific URL or location of the allegedly infringing material on Pagio
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf
- Your physical or electronic signature
We may be unable to process incomplete or improperly formatted notices.
Response Process
Upon receipt of a valid copyright infringement notice, we will:
- Promptly acknowledge receipt of your notice
- Expeditiously remove or disable access to the allegedly infringing content
- Notify the user who posted the content and provide them with a copy of the infringement notice
- Terminate repeat infringers in appropriate circumstances
Counter-Notification
If you believe that your content was removed or disabled as a result of mistake or misidentification, you may send a counter-notification to pagio.app@gmail.com containing:
- Your contact information (name, address, telephone number, and email address)
- Identification of the material that was removed or disabled and its location before removal
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- A statement that you consent to the jurisdiction of the South African courts in your judicial district
- Your physical or electronic signature
If we receive a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the removed content.
